PROBATE

When a loved one dies, it is a difficult time.  The thought of probate at this time and having to hire an attorney can add even more stress and anxiety.  However, probate is unavoidable in most situations in Texas and serves as the method to transfer title of the assets to those left behind.  It is important to hire an attorney knowledgeable in the area of Probate to make the situation as bearable as possible.  As a former staff attorney for a Harris County Statutory Probate Court, Donald S. Worley knows the probate system.

Here are some of the types of probate our firm handles:

  • Probate Administration:  Independent and dependent administration is where the court appoints a personal representative of an estate to gather the assets of an estate, pay the debts and distribute the remaining assets to the beneficiaries.  If the decedent had a will, the personal representative is usually named in the will.
  • Heirship:  When a person in Texas dies without a will or in other situations, an heirship proceeding is necessary for the court to determine the lawful heirs.
  • Other proceedings less complicated than the administration of an estate or an heirship such as Muniment of Title, Affidavit of Heirship and Small Estate Affidavits are options in some situations.
