What is the process for a Divorce?
The divorce process starts with filing an Original Petition for Divorce and providing your spouse with notice of the divorce.
This lets your spouse and the court know that you wish to end your marriage relationship.
If there have been past instances of spousal abuse and you fear for your safety, a Protective Order will be necessary to protect you or your
children from further abuse. Temporary Orders can be put in place to ensure the following will be in place prior to the divorce being finalized:
- Interim alimony
- Child custody and visitation
- Child support amounts
- Health insurance coverage
- Transportation
- Debt and bill payment
Prior to the finalization of your divorce, there will be a period of information-gathering known as discovery.
This process allows us to better determine you and your spouse's assets so that they can be more evenly distributed.
Once both parties agree to a division of property and the care of children, a final decree of divorce can be drafted.
If the parties cannot come to an agreement, a hearing will be required in front of a judge or jury to determine the outcome of the divorce.
How long will it take to get divorced? A divorce cannot be granted until 60 days have passed from the time the Original Petition for Divorce has been filed in court.
This does not guarantee that you will be divorced within 60 days, unless both parties can come to an agreement on the division of property and the care of children.
What is Community Property?
Texas is a community property state. This means that any income or property that was attained during the marriage relationship is owned equally by both the husband and wife. This also applies with debt. Any debt or property owned by an individual prior to the marriage is known as separate property.
